1. About This Policy

Homekind Inc. ("Homekind", "we", "us" or "our") operates HomekindCare along with its sister brands CleaningPros, CleanNextWeek, and HomekindCare Business. This policy explains how we collect, use, disclose, and protect personal information across those brands and their websites.

We handle personal information in accordance with Alberta’s Personal Information Protection Act (PIPA) and, where it applies, the federal Personal Information Protection and Electronic Documents Act (PIPEDA). Both are built on the same ten fair information principles, and this policy is organized around them.

2. Accountability & Our Privacy Officer

Homekind is responsible for the personal information in our custody or under our control, including information we pass to a service provider to process on our behalf. We have designated a Privacy Officer who is accountable for our compliance with this policy and with Alberta and federal privacy law.

3. Personal Information We Collect

We collect only the personal information we need in order to arrange, deliver, and bill for the services you ask us for. Depending on how you deal with us, that can include:

• Contact and identity details — name, phone number, email address, and mailing address
• Service details — the service address, entry and access instructions, parking notes, and who else will be in the home
• Care preferences — the tasks you want help with, routines and schedules, allergies or mobility considerations you choose to tell us about, and visit notes left by your assistant
• Emergency contact details for the client and, where you give them to us, the contact details of family members involved in arranging care
• Account and billing information — quotes, bookings, invoices, and payment records; card details are entered directly into our payment processor and are not stored on our own systems
• Communications — emails, text messages, form submissions, and notes of calls with our office
• Website and device information — IP address, browser and device type, pages viewed, referring page, and similar analytics data collected through cookies

4. Why We Collect It

We identify the purposes for collecting personal information at or before the time we collect it. We use personal information to:

• prepare quotes and respond to enquiries you send us
• schedule, staff, and deliver the home care visits you book
• match the right assistant to a client and brief them on what a visit involves
• send appointment confirmations, reminders, and other service messages
• invoice you, take payment, and keep the financial records we are required to keep
• answer questions, investigate concerns, and resolve complaints
• protect clients, assistants, and our business against fraud, misuse, and safety incidents
• understand how our website is used so we can improve it
• send you marketing about our services, where you have consented to receive it
• meet legal, regulatory, insurance, and tax obligations

5. Consent & How To Withdraw It

We collect, use, and disclose personal information with your consent, unless the law permits or requires us to do otherwise. Consent can be express — you fill out our quote form or tell us in writing — or implied from the circumstances, such as when you book a visit and we need your address to send an assistant to it.

We ask for express consent where the information is more sensitive, and we never make consent to secondary uses such as marketing a condition of receiving care.

You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice, by contacting our Privacy Officer at [email protected]. We will explain what withdrawal means in your case: if you withdraw consent to the information we need in order to deliver care safely, we may no longer be able to provide the service.

6. Limiting Collection, Use, Disclosure & Retention

We limit what we collect to what a reasonable person would consider appropriate in the circumstances, and we collect it by fair and lawful means. We use and disclose personal information only for the purposes it was collected for, for a use that is consistent with those purposes, or with your further consent.

We do not sell personal information, and we do not rent or trade it to third parties for their own marketing.

We retain personal information only as long as we need it for the purposes described here or as long as the law requires — for client and billing records, that generally means up to seven years after your last visit, reflecting Canadian tax and limitation-period requirements. When information is no longer needed, we destroy, erase, or anonymize it.

7. Who We Share It With

We share personal information with service providers who process it on our behalf, under contracts that require them to protect it and to use it only for the purposes we specify. They include:

• Booking Koala — booking, scheduling, and client management
• Stripe — payment processing
• Twilio — text message and voice communications
• Google Cloud Platform and Amazon Web Services — hosting and infrastructure
• PostHog — website analytics and product usage measurement
• Google reCAPTCHA — protecting our forms against automated abuse
• Email delivery providers used to send confirmations, reminders, and newsletters

8. Other Disclosures

We may also disclose personal information to our professional advisors, insurers, and auditors; to emergency services or a health professional where someone’s health or safety is at immediate risk; where the law requires or authorizes it, such as in response to a court order, subpoena, or lawful request from an authority; to establish or defend a legal claim; and to a purchaser or successor as part of a sale, merger, or reorganization of our business, subject to appropriate confidentiality protections.

9. Storage & Transfers Outside Canada

Some of our service providers store or process personal information on servers located outside Canada, including in the United States. While it is outside Canada, personal information is subject to the laws of that country, and courts, law enforcement, and national security authorities there may be able to obtain access to it.

We remain accountable for personal information we transfer for processing, and we use contractual and other means to require comparable protection. You can contact our Privacy Officer for more information about our practices for transfers outside Canada.

10. Accuracy

We keep personal information as accurate, complete, and current as is necessary for the purposes we use it for. Please tell us when your contact details, access instructions, or care preferences change — an out-of-date address or entry code is the most common cause of a missed visit.

11. Security Safeguards

We protect personal information with safeguards appropriate to its sensitivity, including encryption of data in transit over our websites, access controls that limit staff access to what their role requires, multi-factor authentication on administrative systems, secure hosting with reputable cloud providers, and secure disposal of records we no longer need.

Our employees are bound by confidentiality obligations as a condition of employment and are trained on their privacy responsibilities. Keys and entry codes are held under the same controls.

No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send us sensitive health information by email.

12. Cookies, Analytics & Do Not Track

Our websites use cookies and similar technologies. Strictly necessary cookies keep the site working and our forms secure. Analytics cookies, which we use through PostHog, help us understand which pages people find useful so we can improve them.

You can block or delete cookies through your browser settings, though some parts of the site may not work as intended if you do. Our sites do not currently respond to browser "Do Not Track" signals, as there is no common standard for them.

13. Marketing & Electronic Messages

We send commercial electronic messages only in accordance with Canada’s Anti-Spam Legislation. Every marketing message identifies us, gives our contact information, and includes an unsubscribe mechanism.

You can unsubscribe using the link in any marketing message or by writing to [email protected], and we will action the request within 10 business days. Unsubscribing from marketing does not stop the service messages we need to send about your bookings and account.

14. Your Right To Access & Correct Your Information

You may ask us what personal information we hold about you, how we have used it, and who we have disclosed it to. Send your request in writing to our Privacy Officer at [email protected] or the address above, with enough detail for us to find the records and confirm your identity.

We will respond within 45 days of receiving your request, as Alberta’s Personal Information Protection Act requires, or tell you within that period that we need an extension and why. Access is free or, where a fee applies for a more substantial request, we will give you a written estimate before we do the work.

In limited circumstances the law requires or permits us to refuse access — for example where disclosing the information would reveal personal information about someone else, would breach solicitor-client privilege, or relates to an ongoing investigation. Where we refuse, we will tell you why and how to challenge that decision.

If you believe information we hold is inaccurate or incomplete, tell us and we will correct it or, where we disagree, annotate the record with your requested correction and pass the correction on to anyone we disclosed the information to in the past year.

15. Privacy Breaches

We investigate any suspected loss of, or unauthorized access to or disclosure of, personal information. Where a reasonable person would consider that the incident creates a real risk of significant harm to an individual, we notify Alberta’s Information and Privacy Commissioner without unreasonable delay and notify affected individuals as directed, alongside steps to reduce the risk of harm.

16. Children’s Privacy

Our services are arranged by adults and our websites are not directed at children. We do not knowingly collect personal information from anyone under 16 without the consent of a parent or guardian. If you believe a child has given us personal information, contact our Privacy Officer and we will delete it.

17. Links To Other Websites

Our websites may link to sites we do not operate, such as social media pages or partner organizations. This policy does not apply to those sites, and we encourage you to read their privacy policies before giving them personal information.

18. Challenging Our Compliance

If you have a question or complaint about how we handle personal information, please raise it with our Privacy Officer first at [email protected]. We will acknowledge your complaint, investigate it, and tell you the outcome and any steps we have taken as a result.

If you are not satisfied with our response, you may complain to the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca), and, where the federal act applies, to the Office of the Privacy Commissioner of Canada (priv.gc.ca).

19. Changes To This Policy

We review this policy periodically and may update it as our services, our systems, or the law change. The current version is always posted here with the date it was last updated. Where a change is significant, we will bring it to your attention.
