Terms Of Service

1. About These Terms

These terms of service govern your use of the HomekindCare website and the home care services provided by Homekind Inc. ("Homekind", "we", "us" or "our"), an Alberta corporation operating the HomekindCare brand. By booking a visit, requesting a quote, or using this website, you agree to these terms on your own behalf and on behalf of anyone you are arranging care for.

If you are arranging care for another person, you confirm that you have the authority to do so and that you will share these terms with them and with anyone else living in the home.

Where you and Homekind have signed a separate written service agreement, that agreement governs to the extent it conflicts with these terms.

2. Our Services Are Non-Medical Home Care

Homekind assistants offer companionship, check-in visits, transportation and errands, light housekeeping, meal preparation, and help with everyday tasks around the home.

Our services are non-medical. Our assistants are not nurses, physicians, therapists, or other regulated health professionals, and they do not perform any service that requires a licensed health practitioner. In particular, our assistants do not:

  • administer, adjust, or dispense medication (an assistant may remind you that it is time to take medication you manage yourself)
  • perform wound care, injections, catheter or feeding-tube care, or any other clinical procedure
  • provide medical, nursing, dietary, or therapeutic advice, assessment, or diagnosis
  • make health-care decisions on your behalf or act as a substitute decision-maker

3. Emergencies

Homekind is not an emergency service and our office is not monitored around the clock. If there is a medical emergency, a fire, or any immediate risk to a person, call 911 first and then notify our office.

Our assistants are trained in basic CPR and first aid and will call 911 and stay with the client until help arrives, but they cannot substitute for emergency medical responders.

4. Booking, Scheduling & Access To The Home

Visits are arranged through our office and confirmed in writing. Scheduling is subject to assistant availability, and we will tell you promptly if a requested time cannot be met.

So that visits can go ahead as planned, you agree to give us accurate information about the client and the home, to arrange safe access for the assistant at the scheduled time, and to tell us about anything that affects safety in the home — pets, firearms, smoking, infectious illness, mobility hazards, or anyone else who will be present.

We ask that you do not ask an assistant to take on tasks outside the scope of their visit. Assistants may decline any request that falls outside our services or that they reasonably believe is unsafe.

5. Cancellations, Rescheduling & Missed Visits

We ask for three full business days notice to cancel or reschedule a visit so that we can offer the time to another client and keep our assistants working their scheduled hours.

A cancellation made with less than three business days notice may be charged at 50% of the visit cost, and a same-day cancellation may be charged in full. If an assistant arrives and cannot get safe access to the home, the visit is treated as a same-day cancellation.

Our office may waive these charges where the circumstances warrant it — illness, a hospital admission, or a family emergency, for example. Please call us and let us know.

If we have to cancel or reschedule a visit, we will give you as much notice as we reasonably can and you will not be charged for that visit.

6. Quotes, Fees & Payment

Quotes are estimates based on the information you give us and on the hours and services discussed. The final amount is based on the hours actually booked and any additional services you ask for and we agree to.

Visits are billed per appointment to the payment method on file after each completed visit, unless our office has agreed to another arrangement in writing. Prices are in Canadian dollars and exclude applicable taxes unless stated otherwise.

You are responsible for keeping your payment details current and for any bank or card fees charged on a declined or reversed payment. We may pause scheduled visits while an overdue balance is outstanding, after telling you first.

We may change our rates on 30 days notice. Any visit already booked and confirmed before the notice takes effect is charged at the rate you were quoted.

7. No Long-Term Contracts & Ending Service

Home care visits are booked as you need them. There is no long-term contract, no minimum term, and no cancellation penalty for ending service — you can pause, change, or stop recurring visits at any time by giving our office the notice described above.

We may decline, suspend, or terminate service where we cannot staff a visit safely, where the home or the requested care is outside the scope of non-medical home care, where an assistant is subjected to unsafe, abusive, or discriminatory treatment, or where an account remains unpaid. Except where someone’s safety is at immediate risk, we will give you reasonable notice and, where we can, help you make other arrangements.

8. Our Assistants

Every Homekind assistant is our employee. We do not subcontract care to third parties or agencies. Before an assistant works with a client we complete a national criminal record check, and our assistants are bonded, insured, and trained in basic CPR and first aid.

We assign assistants based on availability, location, and the needs of the client. We will do our best to keep the same assistant with you, but we cannot guarantee a specific assistant for any visit.

Our assistants are paid, trained, and insured by us. So that we can keep doing that, you agree not to engage a Homekind assistant privately, whether directly or through another agency, for the services we provide to you while they work for us and for six months after their last visit with you. Nothing here restricts an assistant’s own freedom to work elsewhere.

9. Your Home, Valuables & Keys

Please secure cash, jewellery, medication, firearms, and other valuables before a visit. We ask our assistants not to handle a client’s cash, banking, or identification documents, and not to accept gifts, tips in the form of property, or any interest under a will.

Where you give us a key, alarm code, or entry code, we hold it securely, use it only to provide the services you have booked, and return or destroy it when service ends or when you ask us to.

Tell us within seven days if you believe property has been damaged or has gone missing in connection with a visit, so that we can investigate while the facts are still fresh.

10. Insurance & Limitation Of Liability

Homekind carries commercial general liability insurance and bonding coverage for its assistants, and we hold the workers’ compensation coverage required in Alberta.

We provide our services with reasonable care and skill. We are not responsible for loss or damage that we could not reasonably have foreseen, for the acts of anyone we do not employ, or for the outcome of any medical condition, treatment, or decision — those are matters for the client and their health-care providers.

To the extent the law allows, our total liability arising out of the services in any twelve-month period is limited to the amount you paid us for services in that period, and we are not liable for indirect, incidental, or consequential loss.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, for fraud, or under Alberta’s Consumer Protection Act. Some of these limits may not apply to you if your province does not allow them.

11. Using This Website

The content on this website is provided for general information about our services. It is not medical advice and it is not a substitute for advice from a qualified health professional.

The HomekindCare name, logo, text, images, and page designs belong to Homekind or our licensors. You may use the site for your own personal, non-commercial purposes; please do not copy, republish, scrape, or resell any part of it without our written permission.

You agree not to interfere with the site, attempt to gain unauthorized access to it, or submit anything unlawful, false, or harmful through our forms. We may suspend access to the site at any time for maintenance, security, or misuse.

This site is protected by Google reCAPTCHA, and Google’s privacy policy and terms of service apply to that service.

12. Calls, Texts & Emails

When you book with us or ask for a quote, you agree that we may contact you about your visits, your account, and your quote by phone, text message, or email. These are service messages and you cannot opt out of them while you are a client, though you can ask us to change how we reach you.

Marketing emails are separate. We send them only with your consent and every one carries an unsubscribe link. Standard message and data rates from your carrier may apply to text messages.

13. Privacy

Personal information you give us is handled in accordance with our privacy policy, which forms part of these terms and explains what we collect, why, who we share it with, and how to reach our Privacy Officer.

14. Concerns & Complaints

If something about a visit is not right, please tell our office as soon as you can at [email protected]. We will acknowledge your concern, look into it, and come back to you with what we found and what we are doing about it.

15. Changes To These Terms

We may update these terms from time to time. The current version is always posted here with the date it was last updated, and changes take effect when they are posted. If you keep using our services or this website after that, you accept the updated terms. These terms were last updated on August 13, 2026.

16. Governing Law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You and Homekind agree to the exclusive jurisdiction of the courts of Alberta, without affecting any right you have to bring a claim where you live or to use a consumer dispute resolution process available to you.

If any part of these terms is found to be unenforceable, the rest stays in force.
